As a condition of selling items in a Just Between Friends Consignment Sale, I represent, warrant and agree that the following are true and correct in all respects:
I, understand and agree that Just Between Friends (JBF) Colorado Springs (JBFD Sales, LLC) and Just Between Friends Franchise Systems, Inc. are not responsible for fire, loss, theft or damage to the items I am consigning.
I also understand that JBF Colorado Springs is only a broker or agent for the Consignor. JBF Colorado Springs has no obligation to pay for unsold items. Title possession remains with the Seller.
I understand JBF Colorado Springs will sell the items I am consigning for the price listed on the barcode tags I have created. I understand that the price sold will be controlled by the printed tag attached to the item & not any subsequent changes online. For consignors’ protection, alterations/markings on tags (lowering/increasing price or adding/removing a star) WILL NOT be accepted any time during the sale.
I understand if my item is marked full price, it will only be sold at full price; if my item is marked to reduce, it will be sold at 50% off during scheduled discount hours, and 75% off items marked donate during scheduled shopping time.
I understand that if my items have a star and donate, they will be sold for 75% off on Sunday. This is NOT recommended. If you are donating, your items should be marked reduce.
I verify that no item I am consigning is the subject of any current, pending or threatened recall notice according to the Consumer Products Safety Commission. I have checked for recalls at safety.jbfsale.com
Each item is clean and sanitized, in good operating condition & is not defective, broken or damaged in any way. If any item is returned because it is defective, is missing parts or does not work, I will not be paid any amount for the sale of that item.
I understand that by appearing in a public venue as a shopper or consignor, JBF has my permission to use my image in any JBF publicity avenue they choose, & I agree that no royalty or other payment is due me because of the use of any such image.
I am the owner of and have carefully inspected the items that I am consigning/selling.
DROP OFF:
I understand that my items will by-pass inspection at drop off if I had no more than 3 items returned in previous sales. Unacceptable items will be returned to me. If more no more than 3 of my items are unacceptable, I will by-pass inspection in the future sales
If I have any items over $25 that can fit in a shopping bag (no large equipment) I will have them scanned by JBF staff before putting them on the floor.
PAYOUT INFORMATION
I understand that I will earn 60% of the gross sales received by JBF Colorado Springs for the items I offer for sale. I understand that I will be charged a $20.00 consignor fee. I can prepay my consignor fee and receive a discount.
I understand that there is a 90-day window to retrieve and deposit my check. After that time, a $30 charge will apply to place a stop on the original payment and reissue.
I understand that if I am bringing over 500 items, I will be considered a power consignor. I will be charged an additional $20 consignor fee for each 500 items I bring. I can have these fee waived by helping sort at breakdown. 2 hours of help = $20. 501-1000 items (help 2 hours or pay additional $20). 1001-1500 items (help 4 hours or pay additional $40).
I understand that I will receive an emailed check to the email registered within 14 days of the sale ending. If I need a real check, I will fill out the form and understand there is a $2 fee for this service.
NO THANK YOU ITEMS
I understand that all items requiring batteries must INCLUDE WORKING BATTERIES. If an item requires batteries, I understand that I may incur additional fees of $1.00/battery if any battery-operated items I am selling require a battery replacement during the sale in order to show that the item is in working order.
I understand that I may incur additional fees of $.50/item if I have more than 5 items pulled from the racks/floor for quality.
I understand that puzzles and games should contain ALL PIECES. I will be charged $5 per item that is missing pieces.
JBF reserves the right to remove unacceptable items (stained, broken, missing pieces or missing batteries, recalled) from the sales floor throughout the sale.
By registering to participate, I confirm that: (1) I have read & fully understand this Consignor Agreement & Liability Waiver, including the Representations & Warranties stated above;
By registering for my drop off pass, I confirm that: (2) I agree to and warrant as stated above; & (3) no one has made to me representations, statements, or inducements that change or modify anything written in this Consignor Agreement & Liability Waiver.
